ERG besluit tot definitie Aanmerkelijke marktmacht

Op 28 maart heeft de European Regulators Group (ERG) overeenstemming
bereikt over een definitie van Aanmerkelijke Marktmacht (Significant

European Regulators' Group agrees steps towards implementation of the
New Electronic Communications Package
The European Regulators Group (ERG) which is comprised of the Member
States' National Regulatory Authorities in the field of telecoms, held
its third meeting on 28 March 2003 in Brussels. The Group is
established by the New Electronic Communications Package that is due
to be implemented by the Member States by end of July this year (see
IP/02/259, IP/02/1553, IP/02/1171 and IP/03/119).
The ERG agreed unanimously to appoint Mrs R Hagman, Head of the
Finnish regulatory authority FICORA as Vice Chair up to 30 June 2003,
and Mr Van Heesvelde, Head of the Belgian regulatory authority BIPT,
as Vice Chair from 1 July 2003.
The ERG supported a draft proposal for a Commission Recommendation on
notifications, time limits and consultations under Article 7 of the
Framework Directive. This Article concerns the consultation between
National Regulatory Authorities (NRAs) and the Commission on draft
measures NRAs intend to take on the national level. The draft proposed
Recommendation will be tabled for the April meeting of the
Communications Committee, where the Member States of the EU are
represented. The Commission intends to adopt the Recommendation in
June. Issues surrounding implementation of the new regulatory
framework were also discussed.
It was agreed that the Commission and NRAs would co-operate on
remedies applicable to market parties with significant market power.
It was agreed to develop an ERG position on bitstream access, given its importance in the rollout of broadband services and applications. ERG agreed to examine whether a harmonised approach is needed and possible. This will be added to the ERG Work Programme 2003.
In accordance with the ERG Work Programme the NRAs have produced a
common interpretation of significant market power, based on the
Commission's Guidelines on Market Definition and Market Analysis and
the case-law of the Court of Justice. The interpretation provides for
further guidance on the assessment of significant market power under
the new Framework (see IP/02/1016). It is expected to be published on
the website of ERG within 2 weeks
