EU moet racistische misdrijven beter aanpakken
Wetsvoorstel dient nu spoedig te worden afgerond
Het strafrechtelijk optreden tegen racisme in Europa moet beter worden
geregeld. Het Landelijk Bureau ter bestrijding van Rassendiscriminatie
(LBR) heeft de Europese Commissie en de Europese Raad van Ministers
opgeroepen om in alle lidstaten een gelijksoortige aanpak van
racistische misdrijven te laten plaatsvinden.
Scheidend Eurocommissaris Vitorino, verantwoordelijk voor Justitie,
heeft in mei 2004 burgers en organisaties in Europa de gelegenheid
gegeven om hun visie op het toekomstig beleid op dit terrein kenbaar
te maken. In zijn reactie heeft het LBR gewezen op een Europees
wetsvoorstel uit 2001 dat onder andere het oproepen tot rassenhaat en
geweld, alsmede de ontkenning van de Holocaust strafbaar stelt. Ook
wordt, bij aanname van dit voorstel, in alle lidstaten voor dit soort
misdrijven een zelfde strafmaat gehanteerd.
Het voorstel ligt al geruime tijd op afronding te wachten. De tekst
stuit bij verschillende lidstaten op bezwaren, onder andere omdat
strafrechtelijke maatregelen tegen racistische delicten in een aantal
lidstaten niet gebruikelijk zijn. Ook speelt bij enkele ultrarechtse
partijen met regeringsverantwoordelijkheid de angst mee dat de wet
gebruikt kan worden om hun het werken onmogelijk te maken.
Opeenvolgende EU-voorzitters hebben geen moeite gedaan om de ontstane
impasse te doorbreken. Ook minister Donner van Justitie, die nog tot
eind 2004 het voorzitterschap van de Raad van ministers van Justitie
bekleedt, heeft het onderwerp niet op de agenda van de Raad van
ministers geplaatst.
Het bestrijden van racistische en antisemitische incidenten, zoals die
ook recentelijk in Europa plaatsvonden, zou echter reden dienen te
zijn voor het aannemen van deze wet, aldus het LBR. De organisatie
heeft de Europese Commissie dan ook verzocht om te zorgen voor een
behandeling van het wetsvoorstel op korte termijn.
Het LBR zal dezelfde boodschap naar voren brengen op een conferentie
over de aanpak van racisme in Europa. De Organisatie voor Vrede en
Samenwerking in Europa, de OVSE, organiseert deze bijeenkomst op 13 en
14 september 2004 in Brussel.

Dear Mr. Vitorino,
With reference to the public consultation on the Tampere follow-up, we
would like to ask your attention for the following remarks.
Regarding cooperation in criminal matters:
One of the main issues in the Tampere conclusions was prevention and
combating various forms of racism and xenophobia.
A number of steps have been taken, among which the publication of a
draft Framework Decision on combating racism and xenophobia (COM(2001)
664 def.) in November 2001. In addition, in the Council Framework
Decision of 13 June 2002 on the arrest warrant and surrender
procedures (2002/584/JHA), the crime of racism and xenophobia was
included (Art. 2).
However, after Tampere, the interest to proceed with EU policies and
legislation on this issue seems to have weakened, if not disappeared.
The finalisation of the Framework Decision on racism and xenophobia
was halted in February 2003, the last time the item was tabled on the
agenda of the JHA Council.
The phenomena of racism and xenophobia have all but disappeared in
Europe. Reports issued by the EU Monitoring Centre on Racism and
Xenophobia speak of a continuing appearance of racist ideas and acts
in all MS. In a number of MS, antisemitic incidents have raised fear
among the Jewish community. In some of the new as well as in the old
MS, members of the Roma and Sinti communities are the target of abuse
and violence. In many MS, people of islamic background are confronted
with racist and islamophobic attitudes and calls for violence and
discrimination. Hate speech and racist propaganda finds an easy
platform on the internet, with all its cross-border possibilities.
The LBR is of the view that the need for a common criminal approach in
the EU is obvious and urgent. We urge the Council to finalize the text
of the Draft Framework Decision on racism and call on the Commission
to facilitate this process.
