12 augustus 2016 - Arrondissementsparket Midden-Nederland

The public prosecutor has demanded an prison sentence of eight years against a 42 year old man from Utrecht, ex-husband of Sandra Garcia Geraldino. The Public Prosecutor holds him responsible for the death of his ex-wife, and subsequently burying her body in the vicinity of the J.M. de Muinck
Keizerbrug.

The victim was born in the Dominican republic, lived in Spain and regularly came to The Netherlands to visit her two daughters, a twin, who lived with her ex-partner. Om July 31^st 2015 she also came to The Netherlands to discuss the arrangements concerning parental access and the parental
authority. Fact is that she was present in the ex-husbands home that night, situated at the Vechtplantsoen. After that there was no sign of life. Her eldest daughter, who lives in Belgium, reported her missing on August 3^rd after which the police investigation started.

This investigation shows that she has not travelled or made payments after July 31^st. She did not show up at an important meeting shortly after this date. When she is found, on August 16^th, it turns out that she is killed by force and still wears the same clothes she wore on the evening of
July 31^st. Remains of the pizza, she had eaten that night, were found in her stomach. The suspect declared that they had had a row that night but that she was alive when she left the apartment. One of their daughters, who was in bed at that time, has declared that she has heard her mother
screaming and coughing. Also she has heard stamping and a running tap. At the autopsy several injuries were determined: a double pneumothorax, four broken ribs and perforation of the thoracic membrane and the right lobe of the liver. Forensic experts maintain that these injuries were caused by
one act of violence.

In the forensic investigation drops of blood have been found on the floor of the living room, the DNA of which matches that of the victim. Blood is also found in the car of the suspect, on the back shelf and in the base of the boot. In the DNA of this blood a mixed DNA profile is found which
fits with that of the victim. The body is found in the vicinity of the suspects apartment. A track of the digging shows similarities with the blade of the shovel which was found in the cellar of the home of the suspects parents. Moreover a strong similarity is found between the soil on two
shovels belonging to the suspects parents and the soil in the grave. Finally the victims telephone has been in the possession of the suspect after she was missing. On August 5^th her telephone was used with a telephone card, which was used in the telephone of the suspect a day earlier. That
night the man telephoned with a friend of his ex-wife in Spain and told him that Sandra had decided to stay with him in The Netherlands.

All things considered the public prosecutor holds proven that the man has injured his ex-partners in such a way that she has deceased. She qualifies this as `death in consequence of grievous bodily harm'. Also is it proven that he has buried her in an attempt to conceal this crime. The man
pleaded not guilty and has refused to co-operate with the investigators at the Pieter Baan Centrum. The eldest daughter and sister of mrs. Geraldino, who explained in court the consequences of their mother's death, strongly criticized his silence. Given the gravity of the crime the public
prosecutor demanded the man to be sentenced to prison for a period of eight years.
